Terms of Service

Artref provides:

• AI Prompt Gallery — a curated library of AI artwork, prompts, and inspiration you can browse, search, and copy for your own generations.
• AI Image & Video Generation — create content using third-party AI models (including GPT Image, Midjourney, Seedance, and Nanobanana) via our generation interface. Outputs vary based on your prompts, settings, and model behavior.
• Credits — virtual units used to pay for generations and purchased through secure checkout (Stripe). Credit costs per model are shown on the Generate button before you submit a job.
• Account features — sign-in (Google), favorites, generation history, and billing where enabled.

By creating an account, purchasing credits, clicking "Agree," or using the Service, you confirm that you have read and accept this Agreement and our Privacy Policy. If you do not agree, do not use Artref.

You may not use Artref to:

• Generate or distribute content that violates applicable law (including hate speech, terrorism, CSAM, or other illegal material).
• Infringe intellectual property, privacy, publicity, or other rights of third parties.
• Scrape, reverse engineer, or disrupt the Service (including automated abuse, credential sharing, or denial-of-service activity).
• Misrepresent generated content as human-created where disclosure is required by law or platform rules.

• You must be at least 13 years old to use the Service.
• If you are under 18, you may use the Service only with permission and supervision of a parent or legal guardian.
• Guardians are responsible for a minor's use of the Service.

You are responsible for activity under your account. Keep your sign-in credentials secure. We may suspend or terminate accounts used to harm the Service, other users, or platform integrity.

• Generation requests may be screened by our AI providers and by platform rules before or during processing.
• If a request is rejected by moderation, credits charged for that submission are refunded when the job does not complete successfully.
• No moderation system is perfect. Report concerns to support@artref.ai.

Legitimate prompts may occasionally be blocked. Contact us with details if you believe content was incorrectly filtered.

• Pornographic, explicit, or sexually suggestive imagery.
• Any sexual content involving minors.
• Content promoting sexual services.

• Graphic violence, gore, or content glorifying self-harm or suicide.
• Terrorism or violent extremism.

• Hate speech or content targeting protected characteristics.
• Harassment, bullying, or incitement to violence.

• Instructions for illegal drugs, weapons, fraud, or other unlawful acts.

• Uploading or generating likenesses of real people without their consent.
• Non-consensual intimate imagery (including deepfakes).
• Biometric or identifying data used to impersonate others.

• Unauthorized use of copyrighted characters, logos, trademarks, or brand assets.
• Content intended to counterfeit or impersonate brands.

• You are solely responsible for your prompts, reference uploads, and generated outputs.
• You must ensure your use complies with laws in your jurisdiction.
• Commercial use carries additional risk (publicity, trademark, platform policies). You assume that risk.

• Subject to these Terms and applicable law, you retain ownership of outputs you lawfully generate.
• Paid users receive a commercial license to use their compliant generations commercially, except where third-party model or provider terms restrict certain uses.
• Artref does not claim ownership of your compliant generated content.

• Gallery posts may include third-party prompts, images, and links shown for inspiration.
• Gallery content remains the responsibility of its original creators or rights holders.
• Copying a prompt does not grant rights to underlying artworks, likenesses, or trademarks depicted in reference material.

By submitting prompts, reference images, or other content to the Service, you grant Artref and its subprocessors a non-exclusive, worldwide, royalty-free license to host, process, transmit, store, and display that content solely to operate the Service — including sending inputs to third-party AI providers for inference.

You agree to indemnify and hold harmless Artref and its affiliates from claims arising from your use of the Service, your content, or your violation of these Terms.

• We aim to respond within 7 business days.

We respond to valid copyright notices under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). Rights holders should send a complete takedown notice to support@artref.ai. Counter-notices may be submitted according to applicable law.

If your account or content action is disputed, you may appeal within 30 days by email with additional context. Our decision after review is final internally, without prejudice to your statutory rights.

• Artref sells credits as one-time purchases unless otherwise stated at checkout. There is no auto-renewing subscription unless you explicitly subscribe to a recurring plan shown at checkout.
• Purchased credits are credited after successful payment and are non-transferable.
• Purchased credits do not expire while the Service continues to operate. If we permanently discontinue the Service, we will provide reasonable notice and, where feasible, refund unused purchased credits.
• Complimentary credits (signup bonus, daily refresh, promotions) may be changed or discontinued at any time and are not guaranteed.
• Daily free credits may only be used with models classified as basic on the platform. Premium models require purchased credits. Model classification may change; the Generate UI reflects current rules.
• Credit costs per generation may change when provider pricing changes. The amount shown on the Generate button at submission is authoritative.

• Credits are virtual goods and are generally non-refundable once consumed.
• Refunds may be issued for duplicate charges caused by system error, extended outage (72+ hours) attributable to Artref, or other platform errors we confirm.
• Request refunds at support@artref.ai. We aim to process within 7 business days.

Prices may exclude applicable taxes. You are responsible for any taxes not collected at checkout where required by law.

• Outputs are generated by AI and may be inaccurate, biased, offensive, or infringe third-party rights.
• Verify outputs before publication or commercial use.
• We do not guarantee uniqueness, quality, or fitness for a particular purpose.

• The Service may be interrupted for maintenance, outages, or force majeure.
• We are not liable for failures of third-party providers (including AI APIs, Stripe, or Supabase).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• To the maximum extent permitted by law, Artref's total liability for any claim relating to the Service shall not exceed the greater of (a) amounts you paid Artref in the 12 months before the claim, or (b) USD $100.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill.

• We may suspend or terminate access for violations of these Terms.
• Unused complimentary credits are forfeited on termination. Refunds of unused purchased credits are handled per Section 7 and applicable consumer law.
• Accounts suspended for abuse may not be evaded by creating new accounts.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.

Before formal legal action, contact support@artref.ai and allow at least 60 days for informal resolution.
